WiFiesta Privacy Policy

Effective date: June 30th, 2017

 

This document will help you understand WiFiesta (“WiFiesta App”, “WiFiesta Inc.”, “We”, “Us”, “Our”) Privacy Policy.  We understand that your privacy is important for you. That is why we worked hard to provide you with many privacy setting options within the WiFiesta mobile application, website, WiFiesta service, (together, the "Service").

Our Privacy Policy explains how we and some of the companies we work with collect, use, share and protect information in relation to our Service. You agree that your usage of the Service is consistent with this Privacy Policy and WiFiesta’s Terms of Use available here https://www.wifiesta.com/terms-of-use.

 

 

What Information does WiFiesta Collect?

Personal Information you provide us:

We receive and store information you enter on our Service or provide to us in any other way other. The types of Personal Information collected may include, but is not limited to, your name, email addresses, phone numbers, birthday, gender information, identifiers of social networks linked with WiFiesta and profile photos.

Personal Information you provide us via a third party OAuth access (Google, Facebook, LinkedIn, etc.):

We receive and store information you explicitly permit our Service to access on other platforms. The types of Personal Information collected may include your name, email addresses, phone numbers, birthday, gender information, identifiers of social networks linked with WiFiesta and profile photos. Contact lists and / or friends lists, are used to connect you with your friends who are on WiFiesta, but are never stored permanently. 

Location Information:

When you use our Service, we may collect information about your location. With your consent, we may also collect information about your precise location using methods that include GPS, wireless networks, cell towers, Wi-Fi access points and other sensors such as gyroscopes, accelerometers and compasses. 

Determining your location is fundamental to our Service. We use your location in order to provide you a better Service and customized advertising experience. For example, we use your location information to show you nearby places of interest, to check you into those places or to connect you to the Wi-Fi access point of those places. Another example would be the automatic sharing of contents, photos and videos, between you and your friends who are currently checked in at the same location, taking into account the privacy settings of all involved parties. Also, with your consent, our Service uses your mobile device’s “background location” to be able to check you out of places you have checked in at. We do not request your location in the background for any other reason.

 

Information While you Use our Service:

The type of information we collected may include, but is not limited to, your relationships with other users of WiFiesta and/or the linked social networks, public and private place you created, details of access points you shared on WiFiesta, including, but not limited to, SSID, BSSID, passwords, signal strength and networks speed, checked in locations, your content information and metadata (metadata can describe how, when, where and by whom the content was collected and how that content is formatted), comments, likes, chats and other materials.

 

Device Information: 

We collect device-specific information such as the hardware model, operating system version, advertising identifier, unique application identifiers, unique device identifiers, browser type, language, wireless network and mobile network information (including the mobile phone number).

 

Device Phonebook: 

Because WiFiesta is all about communicating with friends, we may – with your consent – collect information from your device’s phonebook.

 

Analytics Information:

We use third-party analytics tools to help us measure traffic and usage trends for the Service. These tools collect information sent by your device or our Service, including the web pages you visit, add-ons, and other information that assists us in improving the Service. We collect and use this analytics information with analytics information from other Users so that it cannot reasonably be used to identify any particular individual User.
 

Cookies and Similar Technologies:

When you visit the Service, we may use cookies and similar technologies like pixels, web beacons, and local storage to collect information about how you use WiFiesta and provide features to you. We may ask advertisers or other partners to serve ads or services to your devices, which may use cookies or similar technologies placed by us or the third party.

 

Log File Information:

We record information on our server logs from your browser or mobile platform, including your location, IP address, browser type, your web requests, operating information, mobile carrier, device and application username, cookie information, information regarding your use of our Services and the page you requested. We treat this data as non-Personal Information, except where we are required to do otherwise under applicable law. Unless otherwise stated in this Privacy Policy, WiFiesta only uses this data in an anonymous form such as analytics. The information allows for more accurate reporting and improvement of the Service.

 

Information we Collect from Third Parties:

We may collect information that other users provide about you when they use our services. For example, if another user allows us to collect information from their device phonebook — and you’re one of that user’s contacts — we may combine the information we collect from that user’s phonebook with other information we have collected about you. We may also obtain information from other companies that are owned or operated by us, or any other third-party sources, and combine that with the information we collect through our services.


 

How Personal Information is Used by WiFiesta?

In addition to some of the specific uses of information we describe in this Privacy Policy, we may use information that we receive from you and others to help you efficiently access your information, including remembering personal information to to help you gain quicker access to our Service, to provide personalized content and information to you and others, which could include online ads or other forms of marketing material, to provide, improve, test, and monitor the effectiveness of our Service, to develop and test new products and features and diagnose or fix technological issues and to to monitor metrics such as total number of visitors, traffic, and demographic.

 

How Personal Information is Shared with Third Party?

We may share information about you in the following ways:

With WiFiesta User Community

Public information such as your name, date of birth or age, gender, education, home town, current city and all other information in your profile including your profile photos. 

 

Information about how you have interacted with the Service, such as where you are currently checked in, your likes and comments, your reviews of a business or of a product offered by the business. Your friendship relationships may also be shared with other users to help WiFiesta users understand your connections with others using the Service. For example, because it may not be clear whether a new friend request comes from someone you actually know, we may share whether you and the requestor have WiFiesta friends in common. 

 

Any public information or content that you post on the wall of public places, such as a content or a comment, becomes available to all WiFiesta user community, as controlled by any applicable privacy settings that you set. To change your privacy settings on the Service, please change your privacy setting defaults for check in at public and private places. Once you have shared your content or made it public, that content may be re-shared by others, you can, at anytime, change the privacy settings of that content by making it private or accessible to friends only.

 

Information or content that you post on the wall of private places, will be visible only to users checked in at that location. Only users with an explicit invitation from the owner of the private place will be allowed to check in.

 

With Friends of Addressbook and Other Social Networks linked with WiFiesta

In addition to the information accessible by WiFiesta user community, WiFiesta users, whose contacts you have in your address book or who are your friends on any other social network you have linked with WiFiesta will have access to your contacts, email and phone number. They will also be notified when you check-in with them at the same location and so will you.

With Friend of WiFiesta

In addition to the information accessible by WiFiesta user community and by  Friends of other social networks, WiFiesta friends, while they are checked in with you at the same location and as controlled by any applicable privacy settings that you set, will receive in their albums all but your private content that you post on the wall of public and private places. 

With our Affiliates 

We may share information with entities within the family of companies of WiFiesta Inc.

 

With Third Parties

With Service Providers, Sellers and Partners 

We may share information about you or information from cookies, log files, device identifiers, location data, and usage data with service providers who perform services on our behalf, sellers that provide goods through our services and business partners that provide services, advertisement and functionality. We may remove parts of data that can identify you and share anonymized data with abovementioned and other parties. We may also combine your information with other information in a way that it is no longer associated with you and share that aggregated information.

 

With Third Parties for Legal Reasons 

We may share information about you if we reasonably believe that disclosing the information is needed to comply with any valid legal process, governmental request, or applicable law, rule or regulation, investigate, remedy, or enforce potential Terms of Service violations, protect our, our users' or others' rights, property and safety and detect and resolve any fraud or security concerns.


 

With Third Parties as Part of a Merger or Acquisition 

We may share information about you or information from cookies, log files, device identifiers, location data, and usage data if WiFiesta Inc. gets involved in a merger, asset sale, financing, liquidation or bankruptcy, or acquisition of all or some portion of our business to another company, we may share your information with that company before and after the transaction closes.

We may also share with third parties, such as advertisers, aggregated, non-personally identifiable or de-identified information.

 

With Vendors/Contractors

We employ other companies and people, such as independent vendors and contractors, to perform tasks on our behalf and need to share your information with them in order for them to provide services to us. We do not authorize such vendors and contractors to use your Personal Information for their own benefit and we request that they provide a comparable level of protection for your Personal Information.

We may provide aggregate or anonymous information to our partners about how our users, collectively, use our Services, so that our partners may also understand how often people use their services and our Services.

 

How is Personal Information Stored and Secured?

We use commercially reasonable safeguards to help keep the information collected through the Service secure and take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. However, WiFiesta cannot guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed.

 

 

 

How Long we Keep Your Contents?

 

All of your activities on WiFiesta will be kept on our servers for as long as your account is active. Posts on the walls of places, contents you shared temporarily with other WiFiesta users and messages you sent using WiFiesta’s time-bomb mode will eventually be removed from the wall of the place and the devices of the recipients after the set time has expired. However, the original content will always persist in our database and will be associated with you. 

Finally, and this is important, while our privacy settings (Private, Friends Only and Public), our blocking logic (Do not share, Do not receive and Be invisible) and our time-bomb mode are meant to protect your content’s privacy and attempt to limit access or further sharing without your consent, you should understand that users who see the content you provide can always save it using any number of techniques such as screenshots, in-app functionality or any other image-capture technology. It’s also possible, as with any digital information, that someone might be able to access messages forensically or find them in a device’s temporary storage. 

 

How to Delete my Account?

Given the complex relationships and interactions between WiFiesta users, deleting an account (More Options > Devices > Delete Account) is much more complex than it actually sounds. It could take up-to 90 days to complete the entire process. Once the deletion process has been completed, all data such as your photos, videos, relationships, likes and comments, private places you own will be deleted permanently and/or disassociated from your personal information. Certain information such as log files, messages you sent and public places you created are not part of your account and will persist on our servers. Should you you log back into WiFiesta before the deletion process has been completed, the account deletion process will be cancelled.

 

Children Policy

Children under the age of 13 are not allowed to use our Service.  Additionally, we do not permit any messaging interaction between adults and minors unless they already have a friendship relationship on WiFiesta or a linked social network. For example, if an adult and a minor are checked in at the same location and are not friends on WiFiesta or another linked social network, the adult cannot send a message to the minor and vice versa.

 

Users Outside the United States of America

 

Although we welcome WiFiesteros from all over the world, keep in mind that no matter where you live or where you happen to use our Service, your information may be shared within the WiFiesta family of companies. This means that we may collect your personal information from, transfer it to, and store and process it in the United States and other countries outside of where you live.

 

Will There be Changes to This Privacy Policy?

WiFiesta may amend this Privacy Policy from time to time. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. If we make material changes in the way we use Personal Information, we will notify you by posting an announcement on our Services or sending you an email. Users are bound by any changes to the Privacy Policy when they use the Services after such changes have been first posted.
